1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of www.springtek.in (the "Site"), your interaction with Springtek, and your purchase or use of products and services offered through the Site. The Site is operated for the Springtek brand by Ashoka Foam Multiplast Private Limited ("Company", "we", "us" or "our"). "Springtek" refers to the brand owned by the Company. "You" or "your" refers to a visitor, customer or other user of the Site.

By accessing the Site, creating an account, placing an order, submitting content, or otherwise using the Site, you agree to these Terms and to the policies incorporated into them by reference. If you do not agree, please do not use the Site or place an order.

2. Brand Ownership and Leadership

For the avoidance of doubt, Springtek is wholly owned by Ashoka Foam Multiplast Private Limited. Mr. Namit Goel pioneered Springtek's online journey and leads the brand and its growth. His operational, managerial or leadership role does not create personal ownership of the Springtek brand. Ownership of the brand remains with Ashoka Foam Multiplast Private Limited.

Unless expressly stated otherwise, references on the Site to "Springtek", "we", "us" or "our" in a commercial, contractual or ownership context refer to Ashoka Foam Multiplast Private Limited acting through the Springtek brand.

3. Eligibility and Authority

You must be legally capable of entering into a binding contract to place an order. If you are under 18 years of age, the Site should be used only under the supervision of a parent or lawful guardian, and any purchase must be made by an adult who accepts these Terms.

If you use the Site on behalf of a company, firm or other organisation, you represent that you are authorised to bind that organisation to these Terms.

4. Accounts and Information You Provide

You may be able to browse or purchase as a guest or through an account. You are responsible for providing accurate, current and complete information and for keeping account credentials confidential. You must promptly notify us if you believe your account has been accessed without authorisation.

We may refuse, suspend or close an account where reasonably necessary to protect customers, prevent fraud, comply with law, enforce these Terms or protect the Site and our systems.

5. Product Information and Website Content

We aim to present product descriptions, photographs, specifications, dimensions, materials, firmness descriptions, colours, prices and availability accurately. However, the appearance of colours and textures may vary by screen, photography, lighting, production batch and natural material variation.

Mattresses and other soft products may also have reasonable manufacturing tolerances in dimensions, quilting, compression, expansion and finish. Packaging and delivery format may vary by product; for example, certain foam or latex products may be compressed or roll-packed while other products may be delivered flat, as stated on the applicable product page or customer communication.

If a product page, invoice, warranty card, trial policy or written offer contains a product-specific term that conflicts with a general statement in these Terms, the more specific term will apply to that product to the extent permitted by law.

6. Comfort, Orthopaedic and Wellness Descriptions

Terms such as "orthopaedic", "spine support", "back support", "pressure relief", "cooling", "posture support" or similar expressions describe intended product design, comfort characteristics or marketing positioning. They are not medical diagnoses, medical advice, guarantees of treatment or promises to cure, prevent or relieve any disease, injury or health condition.

Individual comfort and support preferences vary. If you have a medical condition, significant pain, injury, allergy or other health concern, please seek advice from a qualified healthcare professional before making a product decision.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products. An order is accepted only when we confirm acceptance or dispatch, or when another clear acceptance event occurs through our order system. An automated acknowledgement of receipt does not necessarily mean that the order has been accepted.

We may cancel or refuse an order before dispatch for reasons such as unavailability, pricing or listing error, payment failure, suspected fraud, delivery restrictions, force majeure or a breach of these Terms. If payment has already been collected for a cancelled order, we will initiate the applicable refund.

8. Prices, Taxes and Payments

Prices shown on the Site are in Indian Rupees unless stated otherwise. Applicable taxes, discounts, delivery charges (if any) and the final payable amount will be shown at or before checkout. Prices and promotions may change without notice, but changes will not normally affect an order already accepted, except where correction is required by law or the order is affected by an obvious pricing or technical error.

Payments may be processed by third-party payment gateways, banks, card networks, UPI providers, wallets, financing providers or other authorised payment services. Their separate terms may apply. We may perform payment and fraud checks before accepting or dispatching an order.

9. No-Cost EMI and Financing

Where a No-Cost EMI or financing option is offered, eligibility, tenure, approval and processing are controlled by the relevant bank, card issuer or financing provider. The bank may charge interest, taxes, processing, foreclosure or cancellation charges in accordance with its own terms. Where Springtek provides an upfront discount intended to offset stated EMI interest, the bank may still show or charge interest in its instalment schedule.

Returns, cancellations and refunds for EMI purchases are subject to our applicable return/cancellation policy and the bank or financing provider's rules. Bank charges, interest, taxes or fees may not be refundable by Springtek. Please review the live No Cost EMI information displayed on the Site before using the facility.

10. Shipping and Delivery

Springtek currently delivers to serviceable locations in India, subject to PIN-code availability and carrier coverage. Delivery dates shown on the Site or in messages are estimates unless expressly stated as guaranteed. Delays may occur because of location, weather, carrier operations, public events, force majeure or other circumstances outside our reasonable control.

You are responsible for providing a correct and complete shipping address and a reachable contact number. Additional delivery attempts, address corrections, re-shipment or storage may be subject to reasonable charges where the delay or failure is caused by incorrect information or unavailability of the recipient.

Please inspect the shipment at delivery where reasonably possible and report visible transit damage, missing packages or incorrect items promptly through our support channels. Your statutory consumer rights are not reduced by this request.

11. Returns, Cancellations, Trials and Refunds

Returns, cancellations, exchanges, trials and refunds are governed by the Springtek Returns and Cancellation Policy, any applicable Trial Policy, the product page and the terms displayed at the time of purchase. Certain benefits may apply only to eligible products, order channels, locations or purchase conditions.

Where a Springtek trial or extended return benefit (including any advertised 101-day benefit) applies, the exact eligibility, start date, minimum-use requirements, exclusions, pickup process and refund conditions will be determined by the applicable live policy and product terms.

Refunds are generally issued to the original payment method where feasible. For cash-on-delivery or other payment modes, we may request appropriate banking details to process the refund. The time taken for a refunded amount to appear in your account may depend on your bank or payment provider after we initiate the refund.

12. Warranty

Springtek products may carry different warranty periods and coverage depending on the product and model. Warranty coverage, exclusions, pro-rata terms, claim requirements and remedies are governed by the live Springtek Warranty Policy, the product page, invoice and any warranty documentation supplied with the product.

Unless the applicable warranty states otherwise, normal wear and tear, comfort preference, misuse, improper foundation/support, accidental damage, unauthorised alteration, stains, cuts, infestation, moisture damage or other non-manufacturing issues may be excluded. Nothing in a warranty policy limits rights that cannot lawfully be excluded.

13. Promotions, Coupons and Offer Codes

Promotions, coupon codes, offer codes, referral offers and sale prices are subject to the conditions displayed with the offer. Unless expressly stated otherwise, offers cannot be redeemed for cash, may not be combinable, may have expiry dates, product exclusions, order-value requirements or usage limits, and may be withdrawn or modified before an order is accepted.

Codes obtained from unauthorised sources may be rejected. If an order is returned or cancelled, the treatment of any promotional discount will follow the applicable offer and return terms.

14. Reviews, Photos and Other User Content

If you submit a review, rating, photograph, video, testimonial, question, comment or other content ("User Content"), you confirm that you have the right to submit it and that it does not infringe another person's intellectual property, privacy, publicity or other rights and is not unlawful, misleading, abusive, obscene, discriminatory, defamatory or malicious.

To the extent permitted by law, you grant Ashoka Foam Multiplast Private Limited a non-exclusive, worldwide, royalty-free licence to host, reproduce, edit for formatting, publish, display, distribute and use the User Content in connection with Springtek, the Site, product information, customer service and marketing. We may moderate, refuse or remove User Content where reasonably necessary.

15. Intellectual Property and Springtek Brand Rights

The Springtek brand name, logos, brand identity, slogans, trade dress, product presentation, domain-related brand assets, goodwill and other proprietary brand elements are owned by Ashoka Foam Multiplast Private Limited, subject to applicable law and any third-party rights expressly identified on the Site.

Website text, graphics, photographs, illustrations, videos, designs, layout, software and other content are owned by the Company or used by it under licence or permission. Third-party trademarks and content remain the property of their respective owners.

Nothing on the Site grants any licence to use the Springtek name, marks or other proprietary content except the limited right to access the Site for personal, non-commercial shopping and information purposes. You may not copy, reproduce, republish, imitate, modify, distribute, scrape, commercially exploit or create misleading associations with Springtek without prior written permission, except where applicable law permits.

16. Acceptable Use of the Site

You agree not to:

• Use the Site for unlawful, fraudulent, abusive or misleading purposes.
• Attempt to gain unauthorised access to accounts, systems, payment information, source code or infrastructure.
• Introduce malware, harmful code, automated attacks or other material that could damage or interfere with the Site.
• Use bots, scraping, data-mining or automated extraction tools in a manner that burdens the Site, circumvents controls or commercially exploits content without permission.
• Impersonate another person, submit false information or misuse another person's personal data.
• Infringe intellectual property, privacy or other legal rights.
• Use the Site to send unsolicited advertising, spam or other unauthorised commercial communications.

17. Privacy and Electronic Communications

Our collection and use of personal data are described in the Springtek Privacy Policy, which forms part of these Terms. By using the Site or placing an order, you may receive transactional communications relating to your account, order, delivery, payment, return, warranty, security or customer service by email, SMS, WhatsApp, telephone or other available channels.

Promotional communications will be handled in accordance with applicable law and your communication preferences. You may opt out of marketing communications using the available unsubscribe or opt-out method, but essential transactional messages may still be sent.

18. Third-Party Services and Marketplace Purchases

The Site may use or link to third-party services such as payment gateways, banks, financing providers, courier tracking, maps, social-media platforms or analytics services. Their own terms and privacy policies apply to their independent services.

If you purchase Springtek products through an online marketplace, retailer or other third-party channel, that platform's terms, payment rules, cancellation process and return procedure may also apply. The seller identified on the applicable invoice is responsible for the sale transaction, while any Springtek manufacturer warranty will be governed by the warranty terms and proof-of-purchase requirements.

19. Availability, Site Changes and Errors

We may update, suspend, withdraw or change any part of the Site, product assortment, features or content from time to time. We do not guarantee uninterrupted or error-free access. We may correct typographical, pricing, inventory, technical or content errors when discovered.

20. Disclaimer of Warranties

Except for express product warranties and rights that cannot be excluded under applicable law, the Site and its general informational content are provided on an "as available" basis. We do not guarantee that the Site will always be uninterrupted, secure, error-free or suitable for every individual purpose.

Product warranties are only those expressly stated in the applicable Springtek warranty documentation or required by law. Nothing in these Terms excludes or restricts statutory guarantees, remedies or consumer rights that cannot lawfully be waived.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Ashoka Foam Multiplast Private Limited will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable and that arise solely from use of, or inability to use, the Site.

Where liability may lawfully be limited in relation to a specific order, our aggregate liability arising from that order will not exceed the amount actually paid to us for the affected product or service. This limitation does not apply where such a limitation is prohibited by law, including liability or remedies that cannot be excluded under applicable consumer-protection law.

22. Your Responsibility for Unlawful Use

To the extent permitted by law, you are responsible for losses or claims caused by your unlawful use of the Site, your infringement of third-party rights, or User Content you submit without the necessary rights or permissions. This clause does not require a consumer to indemnify the Company for matters caused by the Company's own breach, negligence or unlawful conduct.

23. Force Majeure

We will not be responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, epidemic or pandemic measures, strikes, transport disruption, carrier failure, government restrictions, civil disturbance, power or network outages, cyber incidents not caused by our failure to use reasonable safeguards, or similar events. We will take reasonable steps to minimise disruption and fulfil or refund affected orders as appropriate.

24. Suspension and Termination

We may suspend or restrict access to the Site or an account where reasonably necessary for security, fraud prevention, legal compliance, misuse or material breach of these Terms. Clauses that by their nature should continue after termination - including ownership, intellectual property, accrued payment obligations, dispute provisions and limitations permitted by law - will survive.

25. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. We encourage you to contact us first so that we can try to resolve any concern promptly.

Subject to mandatory rights and forums available to consumers under applicable law, courts with competent jurisdiction at Bareilly, Uttar Pradesh, India will have jurisdiction over disputes arising from these Terms, the Site or orders placed directly through springtek.in. Nothing in this clause prevents a consumer from approaching a competent consumer commission, regulator or other statutory forum where the law permits.

26. Changes to These Terms

We may revise these Terms from time to time to reflect changes in law, our business, products, technology or Site practices. The updated Terms will be posted on this page with a revised "Last Updated" date. Material changes will be communicated where required by law. Your continued use of the Site after an update will be subject to the revised Terms, except where a different legal rule applies to an order already accepted.

27. Waiver, Severability and Entire Agreement

If we do not enforce a provision immediately, that does not waive our right to enforce it later. If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms, together with the Privacy Policy, Returns and Cancellation Policy, Trial Policy (where applicable), Warranty Policy, No Cost EMI terms, product-specific terms and any other policy expressly incorporated at checkout, form the agreement governing your use of the Site and purchases made directly through it.
